These Terms & Conditions ("Terms" or "Terms of Use") form a legally binding agreement between BROKKET TECHNOLOGIES PVT. LTD. ("Brokket", "Company", "we", "our", or "us") and any person or entity accessing or using the Brokket platform ("User", "you", or "your").

By accessing or using the Platform, you agree to comply with these Terms.

1. Introduction

The website Brokket, including all subdomains, mobile applications, APIs, communication channels (including messaging services used for updates or communication), and related digital services (collectively, the "Platform") are owned and operated by:

BROKKET TECHNOLOGIES PVT. LTD., a company incorporated under the Companies Act, 2013, India.

These Terms, together with the Privacy Policy and other applicable policies, govern your use of the Platform and Services.

If you do not agree with these Terms, you must immediately stop using the Platform.

2. Definitions

• Account: A registered user profile created on the Platform.
• Services: Technology tools, listings, matching systems, and digital marketplace features offered through Brokket.
• User Data: Information submitted by users during registration or while using the Platform.
• Sub-User: Any authorized representative permitted by a primary user to access the Platform under their supervision.
• Applicable Laws: All laws, regulations, rules, and governmental orders enforceable in India.
• Force Majeure Event : Events beyond reasonable control including natural disasters, pandemics, technical failures, government actions, or similar disruptions.

3. Nature of Platform

Brokket operates as a technology-enabled marketplace platform connecting real estate professionals such as agents, brokers, builders, and developers.

Brokket:

• Facilitates discovery, communication, and collaboration
• Does not act as a broker, agent, or party to property transactions
• Does not guarantee completion of any deal or transaction outcome

All transactions occur solely between users.

4. Acceptance of Terms

By accessing, registering, or using the Platform:

• You acknowledge having read and understood these Terms
• You agree to comply with all policies published on the Platform
• You consent to updates or modifications made from time to time

Continued usage after updates constitutes acceptance of revised Terms.

5. Account Registration

To access certain Services, users must create an Account.

You agree to:

• Provide accurate and complete information
• Update details when required
• Maintain confidentiality of login credentials
• Accept responsibility for all activity under your Account

Brokket reserves the right to suspend or terminate accounts containing inaccurate or misleading information.

6. User Data & Communication Consent

During registration or use, you may be required to provide personal or business information including identification or regulatory details.

By registering, you consent to receiving communications from Brokket through:

• Calls
• SMS
• Email
• Messaging platforms (including WhatsApp or similar services)

Such communication may relate to services, updates, or platform operations.

7. Eligibility

You represent that:

• You are at least 18 years of age
• You are legally capable of entering binding contracts under Indian law
• You are not disqualified under the Indian Contract Act, 1872

Users who are legally incompetent to contract may not use the Platform.

8. License to Use Platform

Subject to compliance with these Terms, Brokket grants you a:

• Non-transferable
• Revocable license

to access and use the Platform solely for lawful business purposes.

9. User Responsibilities

You agree that you will not:

• Interfere with platform operations or security

Users remain solely responsible for content and listings uploaded by them.

10. Accuracy of Information

Brokket does not verify or guarantee accuracy, completeness, or reliability of information uploaded by users.

Any reliance on platform content is at your own risk.

11. Modification of Services

Brokket may, at its sole discretion:

• Add or remove features
• Modify services
• Suspend or discontinue portions of the Platform

Continued use after modifications implies acceptance.

12. Privacy

Collection and processing of personal data are governed by the Brokket Privacy Policy.

By using the Platform, you consent to such data practices.

13. Intellectual Property

All Platform materials including:

• Software
• Branding
• Logos
• Content
• Technology infrastructure

are owned by BROKKET TECHNOLOGIES PVT. LTD. or licensed to it.

Unauthorized reproduction or distribution is prohibited.

14. Suspension & Termination

Brokket may suspend or terminate access if:

• Terms are violated
• Fraudulent activity is suspected
• Legal or security risks arise

Termination may occur without prior notice where necessary.

15. Disclaimer of Liability

Brokket functions only as a technology platform.

The Company shall not be liable for:

• Disputes between users
• Failed transactions
• Financial losses
• Incorrect listings or representations by users

Users interact and transact at their own discretion.

16. Limitation of Liability

To the maximum extent permitted by law, Brokket shall not be liable for indirect, incidental, or consequential damages arising from platform use.

17. Indemnity

You agree to indemnify and hold harmless BROKKET TECHNOLOGIES PVT. LTD., its directors, employees, and partners against claims arising from:

• Misuse of the Platform
• Violation of these Terms
• Breach of applicable laws

18. Force Majeure

Brokket shall not be liable for failure or delay in performance caused by events beyond reasonable control including natural disasters, pandemics, government restrictions, or technical disruptions.

19. Governing Law & Jurisdiction

These Terms shall be governed by the laws of India.

Subject to the immediately following paragraph, courts and tribunals of Faridabad, Haryana shall have exclusive jurisdiction over disputes arising from these Terms or use of the Platform.

Nothing in this clause restricts Brokket from seeking interim or injunctive relief before any competent court.

20. Changes to Terms

Brokket reserves the right to revise these Terms at any time. Updated versions will be posted on the Platform with the revised date.
